Europa.blog reported already about the case of the arrested Moroccan woman-activist. Recently Aaron Rhodes, President – FOREF Europe, wrote an open letter to the Belgium Minister of Justice, Koen Geens.

Dear Mr. Geens,

I am writing on behalf of the Forum for Religious Freedom Europe, an independent, nongovernmental human rights monitoring organization based in Vienna.

We have received information concerning Ms. Kaoutar Fal, a citizen of Morocco born 18/08/1986, with passport number BG8782519 and a valid Belgian visa, who is currently held in detention in the Repatriation Center 127bis, Tervuursesteenweg 300, 1820 Steenokkerzeel.

Ms. Fal was taken into custody at the European Parliament on 11 July 2018, after being released from a prior detention by court order the day before, under circumstances that appear highly irregular. She was eventually delivered to the Federal Police facility at Rue Royale 202. Ms. Fal was detained by unidentified persons. She was only handed over to Police at Rue Royale 202, hours after intensive searches by friends and relatives. According to information we have received, Federal police have no records concerning the reasons for her abduction/capture nor the identities of the abducting parties.

Following her prior arrest, the police and the Immigration Service (DVZ) were ordered on 10 July 2018 by the Court of Appeal, Reference No. 2018/2525, to release Ms. Fal immediately. These legal demands have not been obeyed by order of the Interior Ministry and State Secretary on Migration as mentioned above.

As of this date, Ms Fal remains in custody under very poor conditions.

At the least, this case raises very serious questions that must be clarified if we are to believe your government adheres to the human rights standards to which it has committed itself, as a party to the European Convention on Human Rights, and the International Covenant on Civil and Political Rights.

Your immediate attention to this issue will be most appreciated.

J’écris au nom du Forum pour la liberté de religion en Europe, une organisation non gouvernementale indépendante de surveillance des droits de l’homme basée à Vienne.

Nous avons reçu des informations concernant Mme Kaoutar Fal, citoyenne marocaine née le 18/08/1986, avec le passeport BG8782519 et un visa belge valide, actuellement détenue au centre de rapatriement 127bis, Tervuursesteenweg 300, 1820 Steenokkerzeel.

Mme Fal a été enlevée au Parlement européen le 11 juillet 2018, après avoir été libérée d’une détention antérieure ordonnée par la justice la veille, dans des circonstances qui semblent hautement irrégulières. Elle a finalement été livrée à l’établissement de la police fédérale, rue Royale 202. Mme Fal a été détenue par des personnes non identifiées. Elle n’a été remise à la police rue Royale 202, que des heures après des recherches intensives par des amis et des parents. Selon les informations que nous avons reçues, la police fédérale n’a aucun dossier concernant les raisons de son enlèvement ni les identités des enleveurs.

À la suite de son arrestation antérieure, la police et le Service de l’immigration (DVZ) ont été ordonnés le 10 juillet 2018 par la Cour d’appel, Renvoi n ° 2018/2525, à libérer immédiatement Mme Fal. Ces demandes légales n’ont pas été respectées par ordre du Ministère de l’Intérieur et le Secrétaire d’Etat à la Migration comme mentionné ci-dessus.

A partir de cette date, Mme Fal reste en détention dans de très mauvaises conditions.

À tout le moins, cette affaire soulève des questions très sérieuses qui doivent être clarifiées si nous voulons croire que votre gouvernement adhère aux normes des droits de l’homme auxquelles il s’est engagé, en tant que partie à la Convention européenne des droits de l’homme et au Pacte international relatif aux droits civils et politiques

Votre attention immédiate à ce problème sera très appréciée.
